At the May 18, 2022 Board of Supervisors Meeting, the Board of Supervisors discussed and voted unanimously to desginated a portion of Franklin Road as a Pedestrian Trail only.  Please read the Ordinance below.

FRANKLIN TOWNSHIP

CHESTER COUNTY, PENNSYLVANIA

Ordinance No. 8 of 2022

AN ORDINANCE PURSUANT TO SECTION 2330 OF THE PENNSYLVANIA SECOND CLASS TOWNSHIP CODE (53 P.S. 67203) DESIGNATING PORTIONS OF FRANKLIN ROAD AS A BIKE PATH FOR BICYCLE, PEDESTRIAN, AND EQUESTRIAN USE ONLY.

WHEREAS, the Supervisors of Franklin Township have determined that unpaved portions of Franklin Road as a result of its lack of public use and public convenience shall be designated as bike paths pursuant to Section 2330 of the Pennsylvania Second Class Township Code for bicycle, pedestrian, and equestrian use only; and

WHEREAS, pursuant to Section 2330 of the Second-Class Township Code, the Supervisors may designate bike paths for the protection or convenience of the traveling public. 

BE IT HEARBY ENACTED AND ORDAINED by the Board of Supervisors of Franklin Township, Chester County, Commonwealth of Pennsylvania as follows:

Section 1.  The following section of unpaved road are hereby designated as bike paths pursuant to Section 2330 of the Pennsylvania Second Class Township Code for bicycle, pedestrian, and equestrian use only:

Franklin Road consisting of approximately 1,820 linear feet between the property located at 90 Franklin Road identified as Tax Parcel 72-4-35.2 and the property located a 16 Franklin Road identified as Tax Parcel 72-4-35.1.

Section 2. The above referenced section of road shall be closed to motor vehicles.

Section 3.  Chapter 15, Part 2, Section 201.1.C is amended to delete reference to “Franklin Road (unpaved section).”

Section 4. This Ordinance shall be effective five (5) days from the date of enactment.

Section 5. The provisions of this ordinance are severable, and if any section, sentence clause, part, or provision shall be held illegal, invalid, or unconstitutional by any court of competent jurisdiction, such decision of such court shall not affect or impair the remaining sections, sentences, clauses, parts, or provisions of the ordinance. It is hereby declared to be the intent of the Board that the ordinance would have been adopted if such illegal, invalid or unconstitutional section, sentence clause, part or provision had not been included.

Enacted and Ordained by the Board of Supervisors of Franklin Township, Chester County, Pennsylvania, this 18th day of May 2022.
